1. General Provisions

1.1. This public offer (hereinafter — "Offer") is an official proposal of the Individual Entrepreneur Andreevsky Alexey Alexandrovich (hereinafter — "Service Provider") to enter into a contract for the provision of information technology services for style guide generation (hereinafter — "Services") on the terms set forth below.

1.2. In accordance with paragraph 2 of Article 437 of the Civil Code of the Russian Federation, this Offer is addressed to an unlimited number of persons.

1.3. Acceptance of this Offer is the performance by the Customer of any of the following actions:

  • Registration of an account on the Website;
  • Payment for credits or services;
  • Use of the Service functionality for style guide generation.

1.4. Acceptance means the Customer's full and unconditional acceptance of all terms of this Offer.

3. Terms and Definitions

3.1. Customer — an individual or legal entity that has accepted the terms of this Offer.

3.2. Website — an internet resource located at https://makeui.dev/

3.3. Service — a software product available on the Website that allows generating style guides using artificial intelligence.

3.4. Service (as an action) — generation of a style guide based on a text description (prompt) and uploaded design references provided by the Customer.

3.5. Style Guide — a document in JSON and/or Markdown format containing a color palette, typography recommendations, visual components, and other design system elements generated by artificial intelligence.

3.6. Credits — an internal unit of account on the Website used for payment of Services.

3.7. Personal Account — the Customer's personal section on the Website, available after registration.

4. Subject of the Agreement

4.1. The Service Provider undertakes to provide style guide generation services based on text descriptions (prompts) and uploaded design references at the Customer's request, and the Customer undertakes to accept and pay for these services.

4.2. The result of service provision includes:

  • A style guide in JSON and Markdown formats;
  • A color palette in HEX format;
  • Typography recommendations;
  • Visual component examples.

4.3. Style guide generation is performed using artificial intelligence (Anthropic Claude API).

4.4. IMPORTANT: The results of artificial intelligence may vary. The Service Provider does not guarantee that the result will fully meet the Customer's expectations, as AI interprets prompts individually.

4.5. The service is considered rendered from the moment the Customer is provided with the opportunity to view and download the generated style guide in their Personal Account.

5. Price and Payment Procedure

5.1. The cost of services is determined in credits and is indicated on the page https://makeui.dev/pricing

5.2. Pricing model: Credit system (pay-as-you-go).

  • The Customer purchases credits;
  • Each action (generation, editing) deducts a certain number of credits;
  • Credits do not expire.

5.3. Approximate cost:

  • Style guide generation: from 15 to 50 credits (depending on data volume and complexity);
  • AI-assisted style guide editing: from 5 to 30 credits.

The exact cost is calculated automatically and displayed to the Customer before the operation begins.

5.4. Minimum top-up: 300 rubles / 3 USD.

5.5. Payment is made 100% in advance through the Robokassa payment service.

5.6. Payment methods:

  • Bank cards (Visa, MasterCard, MIR);
  • Fast Payment System (SBP);
  • E-wallets (YooMoney, QIWI);
  • Other methods available through Robokassa.

5.7. The Service Provider applies the Simplified Tax System. VAT is not charged.

5.8. Prices may be changed by the Service Provider unilaterally. Changes take effect from the moment new prices are published on the Website and do not apply to already purchased credits.

6. Service Provision Procedure

6.1. To receive the Service, the Customer:

  • Registers on the Website (required);
  • Tops up the credit balance;
  • Uploads a design reference and/or fills in a text description (prompt);
  • Confirms the start of generation.

6.2. After confirmation, credits are deducted and the generation process begins.

6.3. Generation timeframes:

  • Minimum time: 2 minutes;
  • Average time: 5-15 minutes;
  • Maximum time: 2 hours.

If the maximum time (2 hours) is exceeded, credits are automatically returned to the Customer's balance.

6.4. The finished style guide becomes available in the Personal Account for viewing and downloading.

6.5. Access period to the result: unlimited (as long as the Customer's account exists).

6.6. Re-download capability: unlimited.

7. Rights and Obligations of the Parties

7.1. The Service Provider undertakes to:

  • Ensure the availability of the Service 24/7 (except for technical maintenance with prior notice);
  • Generate a style guide based on the provided data;
  • Provide technical support on Service operation issues;
  • Ensure the confidentiality of the Customer's personal data in accordance with the Privacy Policy.

7.2. The Service Provider has the right to:

  • Suspend the provision of services in case of violation by the Customer of the Offer terms;
  • Refuse to provide services without explanation with a refund of unused credits;
  • Make changes to the Service functionality;
  • Perform technical maintenance with temporary access restrictions.

7.3. The Customer undertakes to:

  • Provide a correct description (prompt) and/or design references for generation;
  • Not use the Service for illegal purposes;
  • Not attempt to gain unauthorized access to the Service;
  • Pay for services in full.

7.4. The Customer has the right to:

  • Receive the service result within the established timeframe;
  • Contact technical support on Service operation issues;
  • Request credit restoration in case of technical failures (see section 8).

8. Refund Conditions

8.1. Refunds are NOT provided, except in cases of technical problems.

8.2. Justification: The service is provided in the form of a credit system. Credits are credited instantly and can be used immediately. The cost of each operation is displayed before it begins. The user confirms the deduction of credits before each action.

8.3. Exceptions (refund is provided):

  • Technical failure during top-up: money was debited, but credits were not credited. Review period: 3 business days. Refund period: 10 business days.
  • Double charge: erroneous repeated debit for one operation. Review period: 3 business days. Refund period: 10 business days.
  • Credit deduction during technical failure: credits were deducted, but the operation was not completed (server error). Credit restoration: within 24 hours after problem confirmation.

8.4. Subjective reasons (refund NOT provided):

  • The result does not meet expectations;
  • "Didn't like it";
  • "Thought it would be different."

8.5. Deadline for appeal: 7 days from the moment the problem occurred.

9. Liability of the Parties

9.1. For non-performance or improper performance of obligations under this agreement, the Parties shall be liable in accordance with the legislation of the Russian Federation.

9.2. The Service Provider is NOT liable for:

  • The quality of the Customer's internet connection;
  • Generation results that do not meet the Customer's expectations (AI gives variable results);
  • The content of generated content if it does not comply with the legislation of the Russian Federation due to an incorrect prompt by the Customer;
  • The commercial result of using the style guide;
  • Losses incurred by the Customer as a result of using the style guide.

9.3. The total liability of the Service Provider is limited to the amount paid by the Customer for the specific operation that caused the dispute.

9.4. The Customer is liable for:

  • The legality of the content of prompts and uploaded references;
  • Violation of third-party rights when using the result.

10. Intellectual Property Rights

10.1. Exclusive rights to the Service software used for style guide generation belong to the Service Provider.

10.2. Rights to the generated style guide:

  • The Customer receives a non-exclusive license to use the style guide for their own needs;
  • The Customer may use the style guide for commercial purposes;
  • The Customer MAY NOT resell the style guide as an independent product.

10.3. The Service Provider reserves the right to use anonymized data about generated style guides to improve the Service.

10.4. The Customer guarantees that the provided prompts and references do not infringe on the rights of third parties.

11. Confidentiality

11.1. Processing of the Customer's personal data is carried out in accordance with the Privacy Policy posted at: https://makeui.dev/privacy

11.2. The Service Provider undertakes not to disclose information received from the Customer to third parties, except as provided by the legislation of the Russian Federation.

11.3. Prompts and generated style guides are stored securely on servers in the Russian Federation.

12. Force Majeure

12.1. The Parties shall be released from liability for non-performance or improper performance of obligations if it was caused by force majeure circumstances:

  • Natural disasters;
  • Military actions;
  • Decisions of government bodies;
  • Large-scale internet failures;
  • DDoS attacks;
  • Blocking of the Service by government bodies.

12.2. In the event of force majeure circumstances, the deadline for fulfilling obligations is extended for the duration of such circumstances.

13. Dispute Resolution

13.1. All disputes under this Offer shall be resolved through negotiations.

13.3. Claim review period: 10 business days from the date of receipt.

13.4. If the dispute cannot be resolved through negotiations, it shall be referred to a court at the location of the Service Provider in accordance with the legislation of the Russian Federation.

14. Changes to the Offer Terms

14.1. The Service Provider has the right to unilaterally change the terms of this Offer.

14.2. The new version of the Offer takes effect from the moment it is posted on the Website, unless otherwise provided by the new version.

14.3. Changes do not apply to already purchased credits and paid services.

14.4. Continued use of the Website after changes are made means the Customer's agreement with the new terms.

15. Final Provisions

15.1. This Offer is drawn up in Russian and is governed by the legislation of the Russian Federation.

15.2. Recognition by a court of any provision of the Offer as invalid does not entail the invalidity of the remaining provisions.
